Online store regulations

1. GENERAL PROVISIONS

  1. The online store szczepaniak.art, operating at: sklep.szczepaniak.art, is run by ART Studio Urszula Szczepaniak, based at ul. Kazimierza Wielkiego 55, 36-020 Tyczyn, NIP: 8133260106, REGON: 363548389.
  2. These Online Store Terms and Conditions define the rules for making purchases in the Szczepaniak form & space online store, in particular the rules and procedures for concluding distance sales contracts via the Store, as well as the complaint procedure and the procedure for withdrawal from the contract by the Consumer.
  3. With regard to services provided electronically, these Terms and Conditions constitute the regulations referred to in Art. 9 of the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws of 2020, item 344, as amended).
  4. The Terms and Conditions are addressed to all Clients of the Store. All Clients are obliged to read the Terms and Conditions before making a purchase.
  5. Each Client is obliged to comply with the provisions of the Terms and Conditions. Sales are conducted based on the version of the Terms and Conditions in force at the time the order is placed.
  6. Each Client can access the Terms and Conditions at any time by clicking on the “Store Terms and Conditions” hyperlink on the Store’s website sklep.szczepaniak.art. The Terms and Conditions may be downloaded and printed at any time.
  7. All information on the Store’s website sklep.szczepaniak.art relating to products (including prices) does not constitute an offer within the meaning of Art. 66 of the Civil Code of 23 April 1964 (Journal of Laws of 2020, item 1740, as amended), but rather an invitation to conclude a contract, within the meaning of Art. 71 of the Civil Code of 23 April 1964 (Journal of Laws of 2020, item 1740, as amended). By sending the Order Form, the Client submits an offer to purchase the specified Product at the price and under the conditions set out in the description.

2. DEFINITIONS

  • Terms and Conditions – this set of rules governing the use of the Store’s Services by Clients.
  • Consumer (contracts concluded before 1 January 2021) – a natural person who concludes a civil law contract via the Store, not directly related to their business or professional activity.
  • Consumer (contracts concluded from 1 January 2021) – a Consumer is considered to be: • a natural person concluding a civil law contract via the Store, not directly related to their business or professional activity – the so-called “Consumer sensu stricto”, and • a natural person concluding a civil law contract via the Store, directly related to their business activity, if the content of the contract shows that it does not have a professional character for that person, particularly arising from the subject of their business activity made available in the Central Register and Information on Economic Activity – the so-called “Entrepreneur with Consumer rights”.
  • For the purposes of these Terms and Conditions, if the distinction between these two groups is not specified, the provisions apply both to Consumers sensu stricto and Entrepreneurs with Consumer rights.
  • Client – a natural person (including a Consumer) who is at least 13 years old (provided they have obtained the consent of their legal representative), a legal person, or an organizational unit without legal personality which is granted legal capacity by special provisions, who uses the Services provided by the Store.
  • Order Form – a Service available on the Store’s website, through which the Client can make a purchase, in particular by adding Products to the Cart and specifying certain terms of the Sales Contract, such as delivery and payment methods.
  • Cart – a part of the Store where the Products selected by the Client are visible, and where the Client can determine and modify Order details, including the quantity of purchased Products.
  • Store – the online service owned by the Seller, available at: sklep.szczepaniak.art, through which the Client may purchase Products from the Seller.
  • Seller – ART Studio Urszula Szczepaniak, based at ul. Kazimierza Wielkiego 55, 36-020 Tyczyn, NIP: 8133260106, REGON: 363548389, who, in the course of business or professional activity, offers sales via their website.
  • Product – a movable item being the subject of trade between the Store and the Client, whose sales terms are specified in the Order Form.
  • Sales Contract – a distance contract for the sale of Products concluded by the Client via the Store, usually through the Order Form.

3. ACCEPTANCE AND FULFILLMENT OF ORDERS

  1. The condition for using the Store is to read and accept these Terms and Conditions. By placing an order, the Client accepts the content of the Terms and Conditions.
  2. Orders from Clients are accepted through the Order Form sent via the website sklep.szczepaniak.art or by email to sklep@szczepaniak.art, 7 days a week, 24 hours a day.
  3. Ordering Products is carried out by selecting the Products, clicking the “ADD TO CART” button, then completing the Order Form with delivery and payment options, and confirming the purchase.
  4. After placing the order, the Client receives confirmation by email.
  5. Once the order is confirmed, processing begins: a. Orders payable on delivery – processed no later than the next business day after confirmation. b. Orders payable by traditional bank transfer – processed after the payment is credited.
  6. Orders are processed during the Store’s business hours: Monday–Friday, 10:00–14:00. Orders placed outside these hours are considered on the next business day.
  7. The Client receives a message confirming the acceptance of the order, which means that the Sales Contract has been concluded.
  8. An invoice without VAT is issued for each order.

  10. The price stated in the order is the gross price and represents the total amount to be paid.
  11. The Seller reserves the right to change prices, introduce new Products, and promotions.
  12. If the order price changes compared to the agreed one, the Client will be informed and must agree to the additional costs.

4. DELIVERY AND SHIPPING COSTS

  1. Shipments are made via courier or parcel locker.
  2. Orders are fulfilled only on business days. Orders placed on weekends or holidays are fulfilled on the next business day.
  3. The delivery time is usually 1 to 30 days (order processing time + shipping time, which is at least 24 hours within Poland).
  4. The Seller is not responsible for delays caused by the carrier.
  5. Domestic shipments in Poland are sent by courier or Inpost parcel locker. Shipping cost from 17.00 PLN depending on size.
  6. International shipments to European countries are sent by courier or Polish Post. The shipping cost is to be agreed via kontakt@szczepaniak.art
  7. International shipments outside Europe are sent by Polish Post. The shipping cost is to be agreed via kontakt@szczepaniak.art
  8. Ceramic shipments, after the order is completed, are sent once a week on Fridays.

5. PAYMENT PROCESSING

  1. Available payment methods:
    • traditional bank transfer;
    • Przelewy24 payment system.
  2. Cash payment: Orders with the delivery option “personal pickup” may be paid in cash at the SZCZEPANIAK form & space office upon order pickup.

6. TERMS OF USING THE STORE AND USER ACCOUNT

  1. Detailed rules on the processing of personal data and cookies are available in the Privacy Policy on the Store’s website.
  2. The Client’s Account enables, among others, logging in, checking order status, editing the delivery address, and contact details.
  3. The Client can change their password in the “My Account” section.
  4. It is recommended to use strong passwords.
  5. The Client is obliged to update account data to ensure proper processing of orders and payments.

7. COMPLAINTS

  1. The Seller is liable under warranty for physical and legal defects of the Product in accordance with the Civil Code.
  2. The definition of physical and legal defects and the Client’s rights are set out in detail in the Terms and Conditions.
  3. The Client may submit a complaint in writing or by email.
  4. The complaint should include the complainant’s details, the reason for the complaint, the demand, the order number, and proof of purchase (optional).
  5. The defective Product should be delivered at the Seller’s expense to the following address: Aleja Generała Władysława Sikorskiego 23, 35-304 Rzeszów.
  6. The Seller will review the complaint within 14 days.
  7. If the complaint is accepted, the Seller will replace the Product or remove the defect within 14 days of submission.
  8. A refund in the event of withdrawal will be made within 14 days of receipt of the Product or proof of its return.
  9. Claims under warranty expire after one year (for Consumers, at least after 2 years).

8. RIGHT OF WITHDRAWAL

  1. The Consumer has the right to withdraw from the sales contract within 14 days of receiving the Product, without providing any reason.
  2. The withdrawal statement should be sent to: Aleja Generała Władysława Sikorskiego 23, 35-304 Rzeszów.
  3. The Consumer must return the Product within 14 days of withdrawal.
  4. The return of the Product is at the Consumer’s expense.
  5. The Seller refunds the payments within 14 days of receiving the Product or proof of its return.
  6. The right of withdrawal does not apply, among others, to items made to order or delivered as inseparably connected with others.
  7. The right of withdrawal applies only to Consumers, not to entrepreneurs.

9. OUT-OF-COURT DISPUTE RESOLUTION

  1. The Consumer may use mediation, arbitration, the consumer ombudsman’s assistance, or the ODR platform (http://ec.europa.eu/consumers/odr/) in case of disputes.

10. PERSONAL DATA PROTECTION

  1. The Client consents to the processing of personal data by the Seller in accordance with GDPR.
  2. The Seller is the data controller.
  3. Data is not transferred to entities not involved in order fulfillment.
  4. The Client has the right to access, correct, and delete their data.
  5. Providing data is voluntary, but lack of consent prevents order fulfillment.
  6. Detailed rules of data protection are contained in the Store’s Privacy Policy.

11. FINAL PROVISIONS

  1. The Terms and Conditions set out the rules for concluding and performing sales contracts for Products.
  2. The contract is concluded between the Client and the Seller.
  3. The Terms and Conditions are available electronically on the Store’s website.
  4. Access to the Store requires internet access and providing an email address.
  5. It is prohibited to post unlawful content on the Store’s website.
  6. In matters not covered, the provisions of law apply.
  7. The Terms and Conditions do not limit the rights of the Consumer arising from legal provisions.
  8. If any provision is invalid, the remaining provisions remain valid, and the invalid provision will be replaced by one consistent with the economic purpose.
